Terms of Service for ReFrame Beta

1. Acceptance of Terms and Beta Status
Welcome to ReFrame. These Terms govern your access to and use of the ReFrame website, mobile application, backend services, AI-powered coaching features, profile setup, practice sessions, reflection pathways, analytics, support flows, and related services.
You agree to these Terms and our Privacy Policy when you check the legal-consent box during onboarding or profile setup, or when you otherwise access or use authenticated ReFrame features. Creating an authentication account may occur before onboarding is complete, but ReFrame may restrict product access until required profile and legal-consent steps are completed.
ReFrame is currently in beta. The Service is provided “as is” and “as available.” Features may change, break, be removed, or become unavailable. We do not guarantee that beta data, practice history, reflections, AI outputs, account records, or analytics will be permanently retained.
ReFrame is currently free during beta. We may introduce subscriptions, in-app purchases, paid plans, or other pricing later. If we do, we will provide advance notice and give you the choice to accept the new terms or stop using the Service.
2. Eligibility
You must be at least 18 years old to use ReFrame. By accepting these Terms or using the Service, you represent that you are at least 18. ReFrame does not currently independently verify your age.
3. Nature of the Service and AI Limitations
ReFrame uses generative AI and third-party AI providers, including OpenAI, to generate coaching feedback, practice scenarios, debriefs, summaries, and reflection support.
ReFrame is for education, reflection, communication practice, and personal/professional growth. It is not legal advice, HR advice, medical advice, mental-health treatment, therapy, diagnosis, crisis support, or a substitute for a qualified professional.
AI outputs may be inaccurate, incomplete, biased, inappropriate, or fabricated. You are responsible for independently evaluating any output before using it in real workplace, legal, medical, HR, or personal decisions.
4. User Content and AI Processing
You may submit profile information, workplace-context details, practice responses, reflection text, feedback, and other content. You retain ownership of your content and the outputs generated for you, subject to ReFrame’s ownership of the platform, prompts, methods, interface, workflows, and underlying technology.
You grant ReFrame a worldwide, royalty-free license to host, store, process, transmit, display, analyze, and use your content and AI outputs as needed to operate, maintain, debug, secure, support, personalize, and improve the Service.
Your content may be processed by third-party providers, including OpenAI and Supabase. ReFrame’s backend sends relevant user inputs and context to AI providers to generate outputs. OpenAI states that API inputs and outputs are not used to train OpenAI models by default unless the API customer opts in, but API data may still be retained or processed under OpenAI’s applicable platform policies.
5. Data Access, Storage, Export, and Deletion
ReFrame stores account, profile, practice, reflection, scenario, feedback, event, heartbeat, and related operational data in its backend systems and database.
Authorized ReFrame administrators may access user data, practice history, AI outputs, feedback, analytics, and operational logs for support, debugging, safety, abuse prevention, product improvement, and service operations. ReFrame does not promise that user content is visible only to the user.
ReFrame currently provides an account-deletion flow. Deletion is intended to remove your account and associated application data from active ReFrame systems, subject to technical limitations, backups, legal obligations, abuse-prevention needs, and records ReFrame may be required or permitted to retain.
ReFrame may provide a data-export feature, but the current export may not include every backend table or operational record associated with your account. Do not treat the export feature as a complete legal data-access report unless ReFrame expressly says so.
6. Acceptable Use
You agree not to use ReFrame to submit or generate content that includes highly sensitive information such as Social Security numbers, classified information, HIPAA-protected health data, strict trade secrets, payment data, or other information you are not authorized to share.
You also agree not to use ReFrame to harass, defame, dox, threaten, manipulate, deceive, commit illegal acts, generate hate or violent content, bypass safety systems, jailbreak AI models, reverse-engineer the Service, or interfere with ReFrame infrastructure.
ReFrame may use technical filters, AI instructions, admin review, rate limits, or account restrictions to enforce these rules, but not all prohibited content is automatically detected or blocked.
7. Account Security
You are responsible for maintaining the security of your login credentials, email account, password, Google OAuth access, and any device used to access ReFrame. Notify us promptly if you believe your account has been compromised.
8. ReFrame Intellectual Property
ReFrame owns the platform, software, source code, visual design, UI/UX, workflows, pathway structures, prompts, methods, branding, logos, analytics systems, and other proprietary materials. These Terms do not transfer ownership of ReFrame IP to you.
9. Suspension and Termination
We may suspend, restrict, or terminate your account or access to the Service at any time, with or without notice, including if we believe you violated these Terms, created risk for ReFrame or other users, abused the Service, or used the Service in a way inconsistent with its intended purpose.
10. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, ReFrame and its affiliates disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, availability, accuracy, and non-infringement.
ReFrame is not liable for workplace disputes, employment outcomes, disciplinary actions, failed negotiations, relationship consequences, business losses, legal exposure, emotional distress, or other real-world outcomes resulting from your use of the Service or reliance on AI outputs.
To the fullest extent permitted by law, ReFrame’s total liability for claims relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless ReFrame, its developers, owners, operators, and affiliates from claims, losses, damages, liabilities, and expenses arising from your use of the Service, your content, your violation of these Terms, or your violation of another person’s rights.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of Texas, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved by binding arbitration administered by the AAA under its Commercial Arbitration Rules. Arbitration will take place in Travis County, Texas.
You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.
